Holding
The court granted bail to the petitioner, holding that the question of suicide versus homicide will be decided at trial and should not bar bail at this stage.
Summary
The petitioner, Ravi Kumar, was arrested in connection with a case registered under Section 108 of the B.N.S. 2023, following an information that his sister had committed suicide after a quarrel with her husband. The brother of the deceased alleged that the husband had an illicit relationship, leading to the suicide. The petitioner contended that he was falsely implicated and that the FIR indicated a case of suicide, not a criminal offence. The informant opposed bail, arguing against release. The court held that the issue of suicide versus homicide would be examined at trial and, therefore, should not preclude bail at this stage, granting the petitioner bail upon furnishing a bond of Rs. 10,000 with two sureties.
Issues considered
- Whether bail should be granted in a case where the alleged offence is linked to a suicide.
- Whether the nature of the alleged act (suicide) warrants denial of bail under Section 108 of the B.N.S. 2023.
