Patna High Court

DEEPAK KUMAR @ DEEPAKversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond of Rs 5,000 and two sureties.

Summary

The Patna High Court heard a bail application filed by Deepak Kumar, who was arrested for the alleged recovery of 118 litres of liquor from a car and two motorcycles under Section 30(a) of the Bihar Excise Act. The petitioner contended that he has a clean antecedent, is not the owner of the seized vehicles, and was detained merely on suspicion, having been in custody since 20‑11‑2025. The State opposed the bail, emphasizing the seriousness of the offence. After evaluating the submissions, the court held that bail could be granted provided the petitioner furnishes a bond of Rs 5,000 with two sureties of the same amount. Accordingly, the petitioner was ordered to be released on bail pending trial.
