Patna High Court

Satyendra Ray @ Satendra RaiversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The Court conditionally granted provisional anticipatory bail, subject to bail bonds, sureties, and verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Satyendra Ray, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 29 litres of liquor were recovered from a riverbank and not from his possession. He relied on a confession made by Sangam Ray while in police custody, which he argued lacks evidentiary value. The petitioner also highlighted that the 2018 amendment to the Excise Act removed the concepts of deemed possession and presumed offender. The State opposed the grant of anticipatory bail. The Court, after considering the submissions, ordered provisional anticipatory bail conditioned on the furnishing of bail bonds and sureties, and directed verification of the petitioner’s criminal antecedents. The order further stipulated that if more than one antecedent case is found, the bail would not be confirmed, whereas confirmation would follow if only one antecedent is verified.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 of the Cr.P.C. in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the confession of a co-accused recorded in police custody has evidentiary value for granting bail.
  • Effect of the 2018 amendment removing the concepts of deemed possession and presumed offender on bail considerations.

                                3. Learned counsel for the petitioner submits that

statement of Sangam Ray in police custody which does not have

any evidentiary value in the eye of law. It is next submitted that

after amendment in the Excise Act in the year 2018, the concept

          away with.

                       5. Learned A.P.P. for the State opposes the prayer for

Court shall verify the criminal antecedent of the petitioner and if

it is found that petitioner has antecedent of more than one case,

it would be presumed that petitioner had concealed his
