Holding

Provisional anticipatory bail is granted subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

The petitioner, Dinesh Yadav, sought anticipatory bail fearing arrest in a case under Sections 30(a) and 47 of the Bihar Prohibition and Excise Act, alleging recovery of 110 litres of liquor from a motorcycle. He contended that he was not arrested on the spot, no liquor was found in his conscious possession, he is not the vehicle's owner, and his name does not appear in the FIR, suggesting a mechanically driven investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.20,000 with two sureties, subject to verification of the petitioner’s criminal antecedent. If the verification shows more than four prior cases, the bail will not be confirmed; if only four, it will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged offences under the Bihar Prohibition and Excise Act and his criminal antecedent.

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession. It is further submitted

that petitioner is not the owner of the seized vehicle and came to

be implicated based on the disclosure made by the local person

petitioner is not disclosed in the FIR which casts an aspersion

on the case of the prosecution. It is next submitted that once an

it is found that petitioner has antecedent of more than four cases,
