Upee Kumar @ Upendra KumarversusThe State of Bihar

Provisional anticipatory bail is granted to the petitioner subject to conditions and verification of his antecedent.

Summary

The petitioner, Upee Kumar, sought anticipatory bail fearing arrest in a case under Sections 30(a), 37 and 45 of the Bihar Prohibition and Excise Act, 2016, alleging that 7 litres of liquor were recovered from another person, Ashok Chaudhary, and not from his own possession. He argued that he has a clean antecedent, the recovery was unrelated to him, and the confessional statement of Ashok made in police custody lacks evidentiary value, especially after the 2018 amendment that abolished the concept of deemed possession. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S., directing the trial court to verify the petitioner’s antecedent before confirming the bail. If any prior case is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the pending excise case.
  • Whether the confessional statement of a co-accused can be relied upon for granting bail.
  • Effect of the 2018 amendment removing deemed possession on the bail application.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession and even the alleged

recovery is from Ashok Chaudhary with whom petitioner has no

Chaudhary in police custody which does not have any

evidentiary value in the eye of law. It is next submitted that after

amendment in the Excise Act in the year 2018, the concept of
