Bablu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court grants bail to the petitioner.

Summary

The petitioner, Bablu Kumar, was arrested in connection with a case alleging possession of 324 litres of liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was falsely implicated, that no liquor was found in his conscious possession, and that he had no prior criminal record. He also argued that the requirements of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, were not complied with. The State opposed the bail application. Considering the lack of incriminating evidence, the petitioner’s clean record, and the procedural lapse, the Court decided to grant bail, directing the petitioner to furnish a bail bond of Rs. 15,000 with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the provisions of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, have been complied with.
  • Whether the petitioner is lawfully implicated in the alleged liquor possession offence.
