Patna High Court

Rakesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court grants bail to the petitioner, directing the furnishing of a bail bond of Rs. 15,000 with two sureties.

Summary

The petitioner, Rakesh Kumar, was arrested on suspicion of involvement in the recovery of 540 litres of liquor from a tempo, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, had no incriminating article in his possession, and was not connected to the vehicle or the liquor, also noting the absence of any criminal antecedent and lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail, but the court considered the facts, the duration of custody since 20.01.2026, and the petitioner’s claim of innocence. Consequently, the court inclined to grant bail, directing the petitioner to furnish a bail bond of Rs. 15,000 with two sureties of equal amount. The order releases the petitioner on bail pending further trial.

Issues considered

  • Whether bail should be granted to the petitioner under the circumstances of the case.
  • Whether the petitioner’s arrest complied with the procedural requirements of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023.
  • Whether the petitioner is materially connected to the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act.
