Patna High Court

Satendra Yadav @ Suga YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

Satendra Yadav was named as an accused in a murder case based solely on information from an informant, who was not an eye‑witness and did not disclose his source. The petitioner contended that he was innocent, had no prior criminal record, and was implicated only on suspicion. The State opposed the bail application. The Court considered the lack of direct evidence, the petitioner’s clean antecedent, and the nature of the allegations, and decided to grant anticipatory bail. The order directed that if arrested within eight weeks, the petitioner could be released on bail of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The bail was to be granted by the Judicial Magistrate, 1st Class, Danapur, Patna.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner who is accused of murder on the basis of an informant’s information.
  • Whether the petitioner’s clean antecedent and the nature of the accusation justify the grant of anticipatory bail.
