Ravindra RaiversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner subject to conditions and verification of his criminal antecedents.

Summary

The petitioner, Ravindra Rai, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 174.765 litres of liquor concealed near a canal, which he claimed was not in his possession and was located on public land. He argued that the informant, a chowkidar, had a personal enmity with him and that the informant’s failure to report earlier cast doubt on the prosecution’s case. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.5,000 with two sureties, subject to verification of the petitioner’s criminal antecedents within six weeks. If more than one prior case is found, the bail will not be confirmed; if only one prior case, the bail will be confirmed. The order was made under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case under Section 30(a) of the Bihar Excise Act.
  • Whether the circumstances, including alleged lack of possession and the informant's motive, justify granting bail.
