Holding

The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Pravesh Kumar, sought anticipatory bail in a case registered under Section 30(a) of the Bihar Excise Act for alleged recovery of 30 litres of liquor from a public place near Katra Baradari. He argued that he was not apprehended at the spot, no liquor was found in his possession, and the FIR omitted the informant's name, casting doubt on the prosecution's case. The State opposed the bail, citing the petitioner’s prior four excise cases. The Court, considering the submissions, granted provisional anticipatory bail on the condition of a Rs.20,000 bail bond with two sureties, subject to verification of the petitioner’s criminal antecedent. It directed that if more than four prior cases are found, the bail would not be confirmed; otherwise, the provisional order would be confirmed.

Issues considered

  • Whether anticipatory bail can be granted in an excise case where the alleged contravention occurred in a public place and no possession is established.
  • Whether the petitioner’s prior criminal antecedent of four excise cases precludes the grant of anticipatory bail.
  • Whether the conditions prescribed under Section 482(2) of the BNSS are satisfied for granting anticipatory bail.
