Patna High Court

Shailesh Rai @ Shailesh YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail should be granted to the petitioner, subject to conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Summary

The petitioner, Shailesh Rai, sought anticipatory bail fearing arrest in an excise case (PS Case No. 101 of 2025) under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 90 litres of liquor recovered from a straw house. He contended that he was falsely implicated, had no criminal antecedent, and that the recovery was from a public open place, with no personal involvement. The State opposed the bail, arguing the prosecution’s case. The court examined the lack of a prima facie case and the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, and consequently granted anticipatory bail subject to a bond of Rs.15,000 and two sureties, imposing conditions under Section 482(2) of the same Act.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the excise case.
  • Whether a prima facie case exists against the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the provisions of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, have been complied with.
  • Whether conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023, are applicable.
