Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

The petitioner, Sunil Kumar, was arrested as the driver of a vehicle from which 120 litres of country-made liquor was recovered, alleged to be in violation of Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act. He claimed innocence, stating he had no knowledge of the goods and that no incriminating material was found in his possession. The petitioner also highlighted the absence of any criminal antecedent and alleged non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the Court considered the facts, the period of custody since 09‑01‑2026, and the lack of direct evidence against him. Consequently, the Court granted bail on the condition of a Rs.15,000 bond with two sureties of equal amount.
