Holding

The High Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and conditions under Section 482(2) of the CrPC.

Summary

The petitioner, Sunil Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 21 litres of liquor concealed near the Balan river, which was not in his possession. He argued he has a clean antecedent and the alleged contraband was found in a public area, not belonging to him, and that the investigation was mechanically driven. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 and two sureties, and directed the trial court to verify the petitioner’s criminal antecedents. If any antecedent is found, the bail would not be confirmed; if none, the bail would be confirmed forthwith. The order was made under the inherent powers of the court pursuant to Section 482(2) of the CrPC.
