The court allowed the anticipatory bail application, granting provisional bail subject to verification of antecedents.

Summary

Awadesh Kumar applied for anticipatory bail after learning that a case had been registered against him under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He contended that he was not arrested at the spot, no liquor was recovered from his possession, and the case was based solely on secret information. The State opposed the bail, arguing the seriousness of the alleged offence. The High Court, after hearing counsel, granted provisional anticipatory bail on a bond of Rs.15,000 with two sureties, subject to Section 482(2) of the Code of Criminal Procedure. The court directed the trial court to verify the petitioner’s criminal antecedents and stipulated that if more than three prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed. The application was therefore allowed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s antecedent criminal cases affect the grant of anticipatory bail.
  • Whether the procedural requirements for anticipatory bail under Section 482(2) of the CrPC have been satisfied.
