Patna High Court

Rahul KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to bond and surety conditions.

Summary

Rahul Kumar, a driver, was arrested after 360 litres of illicit liquor were recovered from a vehicle he was driving. He was charged under Section 30(a) of the Bihar Prohibition and Excise Act and Section 317(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner argued that he had no knowledge of the liquor, had no incriminating material in his possession, and possessed a clean criminal record. The State opposed bail, but the court noted the petitioner’s clean antecedents, short period of custody, and lack of compliance with Section 103 of the BNSS. Consequently, the court granted bail on a Rs.15,000 bond with two sureties and imposed conditions regarding family surety and regular court appearances.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act and Section 317(5) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the non‑compliance with Section 103 of the Bharatiya Nyaya Sanhita, 2023, precludes bail.

no concern with the alleged recovery of liquor. It is submitted

that name of the petitioner has surfaced in this case as being

driver of the vehicle in question and he was oblivious of the fact

opposed the prayer for grant of bail to the petitioner.

          grant bail to the petitioner.

                  7. Let the petitioner be released on bail on furnishing
