Provisional anticipatory bail is granted subject to bond, sureties and verification of antecedents, with the bail to be confirmed only if the petitioner does not have more than fifteen prior cases.

Summary

The petitioner, Lalbabu Mahto, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 8,769.6 litres of liquor from a truck. He argued that he was not arrested at the spot, the liquor was not found in his possession, and he was not the owner of the truck; the FIR did not name the informant who led to his implication. The petitioner also highlighted a history of fifteen prior excise cases, claiming a pattern of mechanical police implicating. The State opposed the grant of anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.75,000 with two sureties and directed the trial court to verify the petitioner’s antecedents, stipulating that if more than fifteen prior cases are confirmed, the bail would not be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Bihar Negotiable Securities Act in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
