Patna High Court

Shankar Kewat @ Shankar NishadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to specified conditions.

Summary

The petitioners, Shankar Kewat and family members, sought anticipatory bail after an FIR alleged that they, armed with lathis and iron rods, assaulted a neighbour, injured family members, and stole a locket and cash on 19 August 2025. They contended that the assault allegation was vague, no specific overt act was ascribed to them, and that the incident stemmed from a petty neighbour dispute, emphasizing their clean antecedent. The State opposed the bail, citing the seriousness of the offences listed under the Bhartiya Nyaya Sanhita. The Court examined whether the allegations were sufficiently specific to deny bail and considered the petitioners' claim of clean record and the grant of anticipatory bail to co‑accused. It granted anticipatory bail, conditioning it on surrender within eight weeks, a bail bond of Rs 10,000 with two sureties, and compliance with Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • What is the adequacy of the specific allegations in the FIR to justify denial of anticipatory bail?
  • Whether the petitioners are entitled to anticipatory bail under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 despite the serious nature of the offences alleged.
