Patna High Court

Shailendra Nut @ Shailendra NatversusThe State of Bihar

Decided

DISPOSED

Holding

The court granted provisional anticipatory bail subject to bond, sureties, and verification of the petitioner’s antecedent.

Summary

The petitioner sought anticipatory bail after an FIR was lodged under Section 30(a) of the Bihar Excise Act alleging recovery of ten litres of liquor from a bush adjacent to his house. He argued he had a clean antecedent, that the liquor was not found in his possession, and that the informant’s identity was omitted from the FIR, casting doubt on the prosecution’s case. The State opposed the bail. The High Court, considering these submissions, granted provisional anticipatory bail on the condition of furnishing a bail bond of Rs. 500 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent. If any prior case is found, the provisional bail would not be confirmed; otherwise, it would be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the FIR, lacking recovery from the petitioner’s possession and omission of the informant’s name, is sufficient to deny bail.
  • Whether the petitioner’s antecedent is clean, affecting confirmation of anticipatory bail.

2 13-03-2026 1. Heard learned counsel for the petitioner and

                   learned A.P.P. for the State.

                             2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                             3. Learned counsel for the petitioner submits that the

petitioner is a person with clean antecedent and allegation is of

recovery of 10 litres of liquor from a bush in front of the house

                   of the petitioner.

                             4. Learned counsel for the petitioner submits that the

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and even the alleged

recovery is from a place which does not belong to the petitioner

but then is adjacent to his house and he came to be implicated at

of the person, who disclosed the name of the petitioner is not

disclosed in the FIR, which casts an aspersion on the case of the

prosecution. It is next submitted that if the Chowkidar was

aware about the involvement of the petitioner in the occurrence,

then why he did not inform the police prior to institution of the

instant FIR, which further casts an aspersion on the case of the

          prosecution.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender within a period of six weeks

from today, be released on Provisional anticipatory bail on

furnishing bail bonds of Rs. 500/- (Rupees Five Hundred) with

the conditions as laid down under Section 482(2) of the BNSS.

                   7. It is made clear that thereafter the learned Trial Court

shall verify the criminal antecedent of the petitioner and in the
