Decided

BAIL GRANTED

Holding

The Court granted bail to the petitioner, finding that the case was based on suspicion and the petitioner had been in custody for an extended period without incriminating material.

Summary

The petitioner, Sunny Mahto, was arrested on 22-12-2025 for alleged possession of 50 litres of liquor recovered from a plastic box, invoking Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he had no incriminating material in his conscious possession, was implicated solely on suspicion, and had no prior criminal record. The petitioner also highlighted that the liquor was recovered from an open public place and that a co‑accused had already been granted bail. The State opposed the bail application. Considering the lack of direct evidence, the extended period of custody, and the statutory provisions, the Court granted bail on a bond of Rs. 15,000 with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of the arrest.
  • Whether the provisions of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, have been complied with.
