The Court provisionally granted anticipatory bail to the petitioner, subject to verification of his antecedent and compliance with the conditions under Section 482(2) of the BNSS.
Summary
The petitioner, Sadhu Choudhary, was implicated in a case under Sections 30(a), 3(C), 32(iii) and 34 of the Bihar Excise Act for allegedly possessing 60 litres of liquor and 400 litres of jawa mahua at his newly constructed house, which is a joint family property. He was not arrested at the scene and no liquor was found in his conscious possession. The prosecution’s case relied mainly on a confessional statement made by his wife while in police custody, which the petitioner’s counsel argued lacks evidentiary value, especially after the 2018 amendment that abolished the concepts of deemed possession and presumed offender. The petitioner, who has a clean antecedent, sought anticipatory bail. The Court granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and directed the trial court to verify his antecedent before confirming the bail.
Issues considered
- Whether anticipatory bail can be granted when the alleged offence involves possession of liquor under the Bihar Excise Act.
- Whether a confessional statement made by the petitioner’s wife in police custody is admissible as evidence.
- Whether the post‑2018 amendment to the Bihar Excise Act eliminates the doctrine of deemed possession and presumed offender.
