The court granted provisional anticipatory bail subject to a bond, sureties and verification of the petitioner’s antecedents, with confirmation contingent on the number of prior cases.

Summary

Mahesh Rai, also known as Mahesh Roy, sought anticipatory bail fearing arrest in a case under Sections 274, 275 of the B.N.S.S. and Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of 1,840 litres of liquor from a pickup vehicle. He contended that he was not caught in possession, was not the owner of the vehicle, and was implicated solely on secret information, a pattern he claimed the police follow in excise matters. The State opposed the bail, arguing the seriousness of the offence. The High Court, after hearing counsel, granted provisional anticipatory bail conditioned on a bail bond of Rs.30,000 and two sureties of the same amount, subject to verification of his criminal antecedents. The court stipulated that if the trial court finds more than six prior cases, the bail would not be confirmed; if exactly six, the bail would be confirmed. The order was made under the inherent powers of the court pursuant to Section 482(2) of the B.N.S.S.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the excise case under Sections 274, 275 B.N.S.S. and Section 30(a) Bihar Prohibition and Excise Act
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are appropriate given the petitioner’s prior criminal antecedents
