Holding

The Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Ramesh Ram, sought anticipatory bail fearing arrest in a case registered under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act for alleged recovery of 11.72 litres of liquor from a bush adjacent to his house. He argued that he was not arrested on the spot, no liquor was found in his possession, and the investigation was based solely on secret information without proper inquiry. The State opposed the bail, contending the seriousness of the offences. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed verification of the petitioner’s criminal antecedent. If the verification shows more than three prior cases, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 of the Criminal Procedure Code in the present facts
