Holding
The Court granted provisional anticipatory bail subject to a bond, sureties and verification of the petitioner’s antecedent, with confirmation contingent on the outcome of that verification.
Summary
The petitioner, Chhotu Singh, sought anticipatory bail fearing arrest in a case under Sections 30(a) and 47 of the Bihar Prohibition and Excise Act, 2016, where 770 litres of liquor were allegedly recovered from motorcycles. He argued that he was not arrested on the spot, no liquor was found in his possession, he does not own the seized vehicles, and his name is absent from the FIR, contending that the investigation was mechanically driven. The State opposed the bail. The Court, considering these submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.30,000 with two sureties and subject to verification of the petitioner’s criminal antecedent by the trial court. If the trial court finds more than six prior cases, the bail will not be confirmed; if six or fewer, it will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of alleged offences under the Bihar Prohibition and Excise Act, 2016.
- Whether the absence of seizure from the petitioner’s possession and omission of his name from the FIR justify granting anticipatory bail.
- Whether the trial court may condition confirmation of anticipatory bail on verification of the petitioner’s criminal antecedent.
