Holding

The Court held that, given the petitioner’s young age, clean antecedent and the circumstances of the case, anticipatory bail is appropriate subject to the conditions prescribed under Section 482(2) of the B.N.S., 2023.

Summary

The petitioner, Golu Kumar, was implicated in a case under Section 74 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and Section 66(E) of the Information Technology Act for allegedly uploading intimate photographs of a woman to social media. He contended that the photographs were taken consensually, that the parties had already married, and that a third party had maliciously circulated the images, leading to the FIR filed by the victim’s mother. The petitioner, a 23‑year‑old with no prior criminal record, sought anticipatory bail, asserting he would not flee or tamper with evidence. The State opposed the bail on the ground of the seriousness of the offences. Considering the petitioner’s clean antecedent, young age, and the nature of the allegations, the Court granted anticipatory bail subject to a cash bond of Rs.10,000 and two sureties, and imposed conditions under Section 482(2) of the B.N.S., 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a case involving alleged violation of Section 66(E) of the IT Act.
  • Whether the nature of the alleged offence and the petitioner’s personal circumstances warrant denial of bail.
