The Court granted bail to the petitioner subject to a bond of Rs.10,000 and two sureties.

Summary

The petitioner, Sanjay Rajak, was arrested in connection with a case registered under Sections 109(1), 115(2), 126(2), 303(2), 74, 352 and 3(5) of the B.N.S., 2023, alleging that he disrobed and attempted to undress the informant's wife and assaulted the informant with an iron rod. The petitioner contended that he was falsely implicated, had no criminal antecedents, and that the injuries reported were minor. The State opposed the bail application, arguing the seriousness of the offences. After hearing both sides, the Court considered the nature of the injuries, the lack of prior record, and the fact that the petitioner had been in judicial custody since 08.01.2026. The Court decided to enlarge bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged offences under the B.N.S., 2023.

                   APP for the State.

                                2. The petitioner has prayed for bail in connection with

Ramgarh Chowk P.S. Case No. 04 of 2026 registered for the

                   offence punishable under Sections 109(1), 115(2), 126(2), 303(2),

                   74, 352 and 3(5) of the B.N.S., 2023.

                                3. The case of the prosecution, in short, is that the

petitioner disrobed and attempted to undress the wife of the

informant and was attempting to tease her. It is further alleged that

the petitioner assaulted the informant on the head with an iron rod.

                                4. Learned counsel appearing on behalf of the petitioner

has submitted that petitioner is innocent and has committed no

offence. He has been falsely implicated in this case. He also

submits that as far as the injury report of the informant is

concerned, the learned trial court has recorded that para 41 of the

case diary refers to the injury report of Mantu Rajak (the

informant) and Yashumati Devi, where Mantu Rajak has received

a minor abrasion in the left leg and forearm and Yashumati Devi

received a deep cut on the upper scalp due to a blunt and abrasion

on the right cheek. He also submits that there is no allegation

against the petitioner of assaulting the wife of the informant, rather

there is an allegation that he has assaulted the informant. The

nature of injuries is simple. Moreover, a statement has been made

in para 3 of the petition that petitioner has no criminal antecedent

and he is languishing in judicial custody since 08.01.2026.

                                  5. The application for bail is opposed by learned APP

                     for the State.

                                  6. Having heard learned counsel for the parties and

considering the facts and circumstances of the case, this Court is

inclined to enlarge the petitioner on bail. The above named

petitioner is directed to be enlarged on bail on furnishing bail bond

of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the

like amount each to the satisfaction of the learned Judicial

Magistrate, First Class, Lakhisarai in connection with Ramgarh

                     Chowk P.S. Case No. 04 of 2026.
