Provisional anticipatory bail is granted subject to bail bond, sureties, and verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Momindra Sahani, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 145 litres of liquor from a river bank. He argued that the liquor was not in his possession, the location did not belong to him, and the FIR lacked details of the informant, casting doubt on the prosecution's case. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.40,000 with two sureties and directed verification of the petitioner’s criminal antecedents. If more than eight prior cases are found, the bail would be withdrawn; if only eight, the provisional order would be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case under Section 30(a) of the Bihar Excise Act.
  • Whether the conditions imposed under Section 482(2) of the BNSS are appropriate for granting anticipatory bail.
