Patna High Court

Chandrahas Paswan @ Shankar PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail subject to the stipulated conditions.

Summary

The petitioner, Chandrahas Paswan, was arrested in connection with the murder of an informant's son and charged under Sections 103(1), 3(5), 61(2) of the B.N.S., 2023 and Section 27 of the Arms Act. The prosecution alleged that the petitioner participated in the killing, while the defence contended that the petitioner was falsely implicated and that his name appeared only in the confession of co‑accused Raushan Kumar Yadav, not in the victim’s statement. The petitioner had been in custody since 24 June 2025 and sought regular bail. The learned Assistant Public Prosecutor opposed the bail application, arguing the seriousness of the offences. After considering the facts, the nature of the charges, and the period of custody, the court found no compelling reason to deny bail. Consequently, the court granted regular bail on a bond of Rs 10,000 with two sureties and imposed a condition of monthly police‑station attendance.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with murder and offences under the B.N.S., 2023 and the Arms Act
  • Whether the evidence on record, including the co‑accused’s confession, justifies denial of bail
