DISPOSED

Holding

The court granted provisional anticipatory bail subject to verification of antecedents and specified conditions.

Summary

The petitioner, Satyawan Singh, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, where 115.720 litres of liquor were recovered from five motorcycles. He contended that he was not in possession of the seized vehicles, was not the owner, and was implicated by a hostile chowkidar who failed to inform police earlier. The State opposed the bail, arguing the seriousness of the offence. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed verification of the petitioner’s criminal antecedents. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; if exactly two, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedents justify denial of anticipatory bail.
  • Whether the circumstances of seizure and lack of possession warrant the grant of anticipatory bail.
