The Court granted bail to the petitioner subject to specified conditions.
Summary
Ashok Kumar was arrested in connection with the recovery of 1.44 litres of liquor from a public lane and charged under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, that no incriminating material was found on his person, and that the liquor was recovered from an open place accessible to the public. The State opposed bail, pointing to his three prior criminal antecedents and alleged non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The Court examined the facts, the length of his custody since 31‑01‑2026, and the lack of direct evidence linking him to the liquor. It granted bail on a bond of Rs 15,000 with two sureties, subject to conditions of a personal surety, regular appearance in court, and non‑interference with evidence or witnesses.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of the case.
- Whether the alleged non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, warrants denial of bail.
- Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
