Decided

DISPOSED

Holding

Provisional anticipatory bail is granted, subject to verification of the petitioner's criminal antecedent.

Summary

The petitioner, Fekan Sah, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 1,130.4 litres of liquor from a hut belonging to Basudev Yadav. He contended that he was not caught in possession, that the recovery occurred on premises not owned by him, and that the complaint was filed by a hostile chowkidar who had not reported the matter earlier. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties, subject to verification of his criminal antecedent by the trial court. The court stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 30(a) of the Bihar Excise Act.
  • Whether the circumstances of the alleged offence and the petitioner's antecedent justify granting anticipatory bail.

Chowkidar was aware of the involvement of the petitioner in the

occurrence then why he did not inform the police prior to
