Patna High Court

Priyanshu Raj @ Prince Raj Singh @ Priyansh Raj @ Ladla KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner subject to a bond and specified conditions.

Summary

The petitioner, Priyanshu Raj, was charged under IPC sections 406, 420, 120‑B, 302, 34 and Arms Act section 27 in Sessions Trial No. 930 of 2025. An earlier regular bail application was rejected, but the court allowed a fresh application three months after the charge was framed on 02‑08‑2025. Since more than three months had elapsed, the petitioner sought bail, despite having a pending case and a criminal antecedent. The State opposed bail, noting that a co‑accused had been released on bail in a similar case. The High Court granted bail on a bond of Rs 30,000 under Section 2(1)(d) of the B.N.S.S., 2023, subject to conditions prescribed in Section 480(3) of the same Act and additional attendance requirements.

Issues considered

  • Whether the petitioner is entitled to regular bail after the lapse of three months from the date of framing of charge despite the seriousness of the offences and his prior criminal antecedents.

3 25-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner seeks regular bail in connection with

Sessions Trial No. 930 of 2025 arising out of Gardanibagh P.S.

Case No. 785 of 2024 lodged on 05.06.2024, for the offence

                   punishable under Sections 406, 420, 120-B, 302 & 34 of the

Indian Penal Code and section 27 of the Arms Act.

                                3. Learned counsel for the petitioner submits that the

regular bail application of the petitioner was earlier rejected

vide order dated 06.08.2025 passed in Cr. Misc. No. 37042 of

2025 with liberty granted to the petitioner to renew his prayer

for bail three months after framing of charge. Counsel submits

that charge has already been framed on 02.08.2025, but since,

this information was not disclosed by the pairvikar to the then

petitioner, therefore, this fact could not be placed in the earlier

rejection order. Counsel submits that more than three months

after framing of charge have been lapsed. Counsel further

submits that the criminal antecedent of the petitioner is not clean

as there is one case pending against him in which he is on bail.

The petitioner is in custody since 20.06.2024. Counsel also

submits that on earlier occasion, report with regard to the

present stage of the trial was called for.

                       4. Learned APP for the State opposes the prayer for

bail of the petitioner and submits that on earlier occasion, report

with regard to the present stage of the trial was called for and

from the said report, it transpires that the co-accused having

same allegation was granted bail by the Co-ordinate Bench of

this Court vide order dated 13.05.2025 passed in Cr. Misc. No.

7941 of 2025. It also transpires that the charge has been framed

and summons to the witnesses have been issued.

                       5. In the present facts and circumstances of this case,

let the above named petitioner be granted bail, on furnishing

bail bond of Rs.30,000/- (Rupees Thirty Thousand) as

mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the

satisfaction of A.D.J.-II, Patna in connection with Sessions Trial
