Patna High Court

Prashant KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Prashant Kumar, was arrested in connection with a case registered under multiple offences including assault, harassment and sections of the POCSO Act. He is alleged to have abused a minor victim and assaulted the victim's grandmother, causing only simple injuries. He has been in custody since 23 December 2025. The petitioner applied for bail, arguing that the nature of the injury was minor and the period of detention was lengthy. The High Court, after hearing counsel, granted bail on the condition of a Rs.10,000 bond with two sureties, noting that the order is limited to the bail application and does not prejudice the trial.

Issues considered

  • Whether bail should be granted to the petitioner given the nature of the offences and the simple injury caused.
  • Whether the period of custody and the seriousness of the charges warrant continued detention.
