Bail is granted to the petitioner subject to monetary bond and specified conditions.
Summary
The petitioner, Rahish Uddin, a driver, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act after 384.840 litres of liquor were recovered from a vehicle he was driving. He contended that he had no knowledge of the goods, no incriminating material was found in his possession, and he had no prior criminal record. The prosecution opposed bail, while the petitioner’s counsel argued that the requirements of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, were not complied with. The Court considered the facts, the period of custody since 15‑01‑2026, and the petitioner’s lack of antecedents. It decided to grant bail on a bond of Rs.15,000 with two sureties, imposing conditions of personal surety, regular appearance, and non‑interference with evidence or witnesses.
Issues considered
- Whether bail should be granted to an accused under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
- Whether the petitioner poses a risk of tampering with evidence or fleeing.
