Prabhu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, subject to bond and conditions.

Summary

Petitioner Prabhu Kumar was arrested in connection with a case under Sections 33 and 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 700 litres of spirit in a Bolero vehicle. He contended that he was merely the registered owner of the vehicle, had no knowledge of the contraband, and that no incriminating material was found in his possession. The petitioner also highlighted his clean record and the alleged non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, arguing the seriousness of the offence. After considering the custody period, lack of direct evidence, and the petitioner’s circumstances, the Court granted bail subject to a bond of Rs.15,000 with two sureties and conditions regarding appearance, non‑tampering with evidence, and non‑intimidation of witnesses.

Issues considered

  • Whether bail should be granted to the accused in offences under the Bihar Prohibition and Excise Act in the absence of direct incriminating material.
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
