Holding

Bail was granted to the petitioner.

Summary

Gajendra Mandal was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act after 57.75 litres of liquor were recovered from an open field. The petitioner claimed he had no involvement, no incriminating material was found on him, and he had no prior criminal record. He had been in custody since 14 January 2026 and argued that the prosecution had not complied with Section 103 of the BNSS, 2023. The State opposed bail, but the court noted the petitioner’s clean antecedents and the length of custody already served. Consequently, the court granted bail on a bond of Rs.15,000 with two sureties of the same amount.
