DISPOSED

Holding

The court granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Baban Singh, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022, alleging that the alleged recovery of liquor was from a location not belonging to him and that he was implicated based on secret information without proper investigation. The petitioner had one prior case under the Excise Act. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on the petitioner furnishing a bail bond of Rs.5,000 with two sureties and subject to verification of his criminal antecedents under Section 482(2) of the CrPC. The court clarified that if verification reveals more than one prior case, the bail would be cancelled; otherwise, it would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the alleged recovery of liquor and the manner of investigation justify denial of bail.
