Patna High Court

Nitish Kumar ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners.

Summary

The petitioners, Nitish Kumar Chaudhary and Rishi Chaudhary, were arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 200 litres of country-made liquor. They contended that they were merely passengers in the vehicle, had no knowledge of the liquor, and no incriminating material was found on them. The State opposed bail, but the petitioners highlighted their lack of criminal antecedent and the non‑compliance of Section 103 of the BNSS, 2023. The Court examined these facts, noting the petitioners' limited involvement and the duration of custody. Consequently, the Court granted bail, directing the petitioners to furnish a bail bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given they were passengers with no knowledge of the contraband
  • Whether the non‑compliance of Section 103 of the BNSS, 2023, affects the grant of bail
