Patna High Court

Sonu Kumar Singh @ Amajeet Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to a bail bond, sureties and conditions of cooperation.

Summary

The petitioner, Sonu Kumar Singh, was implicated in a FIR (Dariyapur PS Case No. 664 of 2022) alleging offences under sections 307, 341, 323, 324, 325, 379, 504, 506 and 34 of the IPC, involving armed assault and injuries. He applied for anticipatory bail, asserting that a compromise had been reached between the parties and that he had no prior criminal record. The State opposed the application. The Court examined the fresh ground of compromise, the absence of antecedent criminal history, and the nature of the alleged offences. Considering these factors, the Court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to cooperate with the investigation, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the B.N.S.S, 2023. The order was made by Justice Soni Shrivastava.

Issues considered

  • Whether anticipatory bail can be granted in a case involving multiple serious IPC offences.
  • Whether the existence of a compromise between the parties justifies the grant of anticipatory bail.
  • Whether the petitioner’s lack of prior criminal antecedent influences the decision on anticipatory bail.
  • Applicability of Section 438(2) CrPC and Section 482(2) B.N.S.S, 2023 in imposing conditions on anticipatory bail.

                                4. Learned counsel for the petitioner submits that the

prayer for bail has been renewed on behalf of petitioner with

It is further submitted that the criminal antecedent, as stated in

the earlier petition, has now been clarified inasmuch as a final

form had already been submitted in the said case, which could

not be placed on record earlier. Even on merits, there is an
