The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.
Summary
The petitioner, Laddu Nut, sought anticipatory bail fearing arrest in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, alleging that 7 litres of liquor and 200 litres of Mahua were seized from a hut adjacent to his house. He contended that he was not arrested at the spot, had no possession of the contraband, and was implicated on the basis of a hostile chaukidar’s information without proper investigation. The State opposed the bail, arguing the seriousness of the offence and the petitioner’s prior two excise cases. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on furnishing a bail bond of Rs 10,000 with two sureties and subject to verification of the petitioner’s criminal antecedent. It further directed that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
- Whether the petitioner’s prior two excise cases affect the grant of anticipatory bail.
