The court granted bail to the petitioner subject to specified conditions.
Summary
The petitioner, Uday Kumar, a driver, was arrested after 2,701.8 liters of foreign liquor were seized from his truck in Gaya and was charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act. He contended that he had no knowledge of the liquor, no incriminating material was found in his possession, and that he was falsely implicated, despite having one prior criminal antecedent and the alleged non‑compliance with Section 103 of the BNSS, 2023. The State opposed bail, arguing the seriousness of the offence. The High Court, after considering the facts, the period of custody, and the lack of direct evidence against the driver, decided to grant bail. Bail was conditioned on a bond of Rs.15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s regular appearance in court.
Issues considered
- Whether bail should be granted to the accused under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
- Whether the alleged non‑compliance with Section 103 of the BNSS, 2023, bars the grant of bail.
