The High Court granted a further extension of time for surrender up to 21‑04‑2026, leaving the remainder of the earlier order intact.

Summary

The petitioners, Subhash Mahto and Sadhu Mahto, filed a petition seeking modification of an earlier order dated 23‑12‑2025 which had granted them a limited period to surrender and furnish a bail bond before the District Court. They pleaded that they required a further extension of time for surrender, supported by an affidavit and reasons detailed in the modification application. The Patna High Court, after hearing counsel for both parties, considered the reasons and found them sufficient to grant an additional extension. Consequently, the court extended the deadline for surrender to 21‑04‑2026 while leaving the rest of the 23‑12‑2025 order unchanged. The modification application was therefore disposed, effecting only the time‑extension component.

Issues considered

  • Whether the High Court can modify the earlier order to extend the time for surrender and furnishing of bail bond
