Patna High Court

Abhishek Kumar @ Abhishek YadavversusThe State of Bihar

Holding

The Court held that the surrender period can be extended when the petitioner is unable to comply due to a serious illness.

Summary

The petitioner, Abhishek Kumar, was directed by the Patna High Court on 11 October 2023 to surrender within six weeks for bail proceedings. He was unable to do so because he suffered a serious illness from 8 to 23 November 2023, during which his doctor prescribed bed rest. He filed a modification application seeking an extension of the surrender deadline. The State of Bihar did not object to the extension. The Court, after hearing both sides, allowed the modification and granted an additional four weeks for the petitioner to surrender, keeping the original bail conditions intact.
