Patna High Court

Md. Noman Khan @ Noman KhanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioners subject to bond and conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Summary

The petitioners, Md. Noman Khan, Md. Tarique Khan and Md. Sadique Khan, sought anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 109, 308(3), 352 and 3(5) of the Bharatiya Nyaya Sanhita for alleged assault with lathi and demand for a Rs.2,00,000 ransom. The prosecution alleged that the accused, along with others, assaulted the informant and demanded ransom. The petitioners contended that they were falsely implicated due to political rivalry, that the allegations were vague and omnibus, that the injuries were minor, and that they have clean antecedents. The State opposed the grant of anticipatory bail. Considering the general nature of the accusations, the clean record of the petitioners and the political context, the Court allowed anticipatory bail subject to a bond of Rs.10,000 each with two sureties and conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Issues considered

  • Whether anticipatory bail should be granted in view of the alleged offences under the Bharatiya Nyaya Sanhita
  • Whether the allegations against the petitioners are specific enough to deny bail
  • Whether the petitioners' clean antecedents and the political rivalry context warrant bail
