Patna High Court

Ramdev SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to a bond and specific conditions, as the allegations were general and no specific evidence was presented.

Summary

The petitioner, Ramdev Sah, sought bail fearing arrest in a complaint (Case No.103 of 2023) alleging offences under IPC sections 323, 504, 498A, 307, 313, 34 and Dowry Prohibition Act sections 3 and 4. The FIR alleged that he, together with family members, assaulted the complainant and expelled her from her matrimonial home. The petitioner claimed innocence, stating that the allegations were general and omnibus, that he is the complainant’s father‑in‑law, does not reside with the complainant, and has no criminal record. The State’s counsel did not contest these submissions. The Court observed that the allegations were indeed general and, in the absence of specific evidence, ordered the petitioner’s release on bail subject to a bond of Rs.10,000 with two sureties and several conditions under Section 482(2) of the BNSS. The bail order also imposed obligations to appear before the trial court, refrain from tampering with witnesses or evidence, and not commit further offences.

Issues considered

  • Whether bail should be granted to the petitioner when the allegations are general and omnibus in nature
  • Whether the petitioner’s lack of criminal antecedents and the absence of specific evidence warrant bail
