Mithilesh Kumar @ Chandan KumarversusThe State of Bihar

The court granted provisional anticipatory bail to the petitioner subject to conditions and verification of his antecedent.

Summary

The petitioner, Mithilesh Kumar, sought anticipatory bail fearing arrest in a case under Sections 30(a), 32(i)(ii) and 41 of the Bihar Excise Act for allegedly possessing 180.360 litres of liquor in a Scorpio vehicle. He argued that he has a clean antecedent, was not caught in possession, and the case against him rests solely on a confessional statement of another accused made in police custody, which he claimed lacks evidentiary value. The State opposed the bail, contending that the allegations merit prosecution. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs. 500 with two sureties and appear before the trial court within six weeks. The court directed the trial court to verify the petitioner’s antecedent and stipulated that if any prior case is discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith. The order was made under Section 482(2) of the BNSS, exercising the court’s inherent powers.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances.
  • Whether a confessional statement of a co-accused made in police custody can form the basis for granting anticipatory bail.
  • Whether the petitioner’s clean antecedent influences the grant of anticipatory bail.
  • Whether the High Court can impose conditions and a provisional nature to anticipatory bail under Section 482(2) of the BNSS.

                                   6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the event

shall verify the criminal antecedent of the petitioner and in the

event if it is found that petitioner has antecedent of even one case

then it would be presumed that petitioner, for the purposes of

Court, as such, the provisional anticipatory bail order shall not be

confirmed, but after verification if it is found that petitioner is a
