Md. Arju AnsariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioners, subject to specified conditions.

Summary

The petitioners, Md. Arju Ansari and Md. Arsad, were arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 575.250 litres of foreign liquor. They claimed innocence, stating they were merely the driver and co‑driver and had no knowledge of the illicit liquor, and that no incriminating material was found on them. The State opposed bail, while the petitioners highlighted their clean record and the alleged non‑compliance of Section 103 of the BNSS, 2023. Considering the facts, the court found the petitioners’ custody period excessive and the lack of direct evidence, and therefore granted bail. The bail was conditioned on a bond of Rs.15,000 each, two sureties, a family member as bailor, and mandatory appearance at every trial date.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of the case
  • Whether the non‑compliance of Section 103 of the BNSS, 2023, affects the grant of bail
