Holding

The court held that provisional anticipatory bail may be granted subject to bond, sureties, and verification of the petitioner’s antecedent.

Summary

Santosh Sahni applied for anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act, alleging recovery of liquor from a location behind Md. Sallaudin's house and from a sack in his cowshed. He asserted he had no conscious possession, a clean criminal record, and that the liquor was concealed by someone hostile to his family. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs. 500 with two sureties and subject to verification of his antecedent under Section 482(2) of the BNSS. The order directs that if any antecedent is discovered, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the alleged recovery of liquor establishes sufficient grounds for arrest.
  • Whether the petitioner’s clean antecedent warrants the grant of anticipatory bail.

no prudent person would use his own premises for committing

in the event if it is found that petitioner has antecedent of even

one case then it would be presumed that petitioner, for the
