The Court conditionally granted provisional anticipatory bail to the petitioner.
Summary
Guddu Kumar, accused under Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of 8,769.6 litres of liquor from a truck, applied for anticipatory bail, claiming he was not arrested at the spot, had no conscious possession of the liquor, and was not the owner of the vehicle. He argued that the FIR was based on undisclosed secret information and that similar cases had been mechanically filed against him. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.20,000 with two sureties and compliance with Section 438(2) Cr.P.C. and Section 482(2) of the B.N.S.S., with a further condition that the trial court verify his criminal antecedent. If more than four prior cases are found, the bail will not be confirmed; if only four, it will be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in a case under the Bihar Prohibition and Excise Act
- Whether the petitioner’s alleged lack of conscious possession and ownership of the seized vehicle warrants bail
