The Court conditionally granted provisional anticipatory bail, subject to bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Sanoj Kumar, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 90 litres of liquor were concealed near a community hall. He argued that he was not arrested at the spot, no liquor was found in his possession, and the allegation was based solely on secret information, despite having two prior excise cases. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties and appear before the trial court within six weeks. The order also directed verification of the petitioner’s criminal antecedent, stipulating that if more than two prior cases are found, the bail would not be confirmed; if only two are found, the bail would be confirmed. The decision was based on the provisions of Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
