Holding
The Court held that the petitioners are entitled to bail, subject to a bond of ₹30,000 each and conditions prescribed under Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 and Section 482(2).
Summary
The petitioners, Rana Rakesh Ranjan and Rajesh Singh, were accused in a FIR dated 11‑02‑2025 for alleged violent conduct involving firearms and weapons, charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023. They claimed innocence, argued that the FIR was filed six days after the incident and was frivolous, and highlighted their prior criminal antecedents. The State opposed bail, acknowledging the delay but emphasizing the seriousness of the offences. The Court considered the delay, the nature of the allegations, and the petitioners’ personal circumstances, and ordered that they be released on bail upon furnishing a bond of ₹30,000 each, subject to conditions under Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 and Section 482(2). The bail order was conditioned on surrender within four weeks and compliance with the learned CJM’s satisfaction.
Issues considered
- Whether the petitioners are entitled to bail despite charges under sections 191, 190, 115, 126, 118, 109, 329, 351, and 352 of the Bharatiya Nyaya Sanhita, 2023.
- Whether the six‑day delay in filing the FIR and the claim of frivolous allegations justify granting bail.
- Whether the petitioners' prior criminal antecedents preclude the grant of bail.
